APPELLATE PRACTICE HIGHLIGHTS
David has litigated appeals in all 5 appellate districts.
He successfully appealed a shared parenting schedule on behalf of the father in the case of Ford v. Virgin, 2021 IL App (3d) 190650. Virgin is, and still remains, the leading case on 50/50 parenting time in Illinois.
David also successfully reversed a trial court ruling interpreting Illinois' SIJS statute for immigrants; see In re Parentage of Ervin C.-R., 2020 IL App (2d) 200236. This decision is the first interpreting the recently enacted SIJS statute.
In January of 2022, David reversed an improperly set child support award in the Appellate Court's decision of Britton v Britton, 2022 IL App (5th) 210065. It's also the leading case on credibility imputation under the second prong of Gosney. (See IRMO Gosney, 394 Ill. App. 3d 1073 (2009))
And in March of 2022, David joined the Cook County Child Protection Division's Appellate Panel. This small group of appellate lawyers represent low income parents facing neglect or termination of their parental rights.
TRIAL PRACTICE
David limits his trial practice to post judgment litigation. Such as 1401 petitions or matters falling under section 1203. Or other matters related to his appellate practice.
